Terms of Service
1. Agreement and Scope
These Terms of Service ("Agreement") govern the use of the medical scribe platform provided by Listen MD AI ("Company," "we," "us"). By accessing the platform, the healthcare provider ("User," "you") agrees to these terms.
2. Professional Responsibility (Clinician-in-the-Loop)
Final Oversight: The platform uses AI (including Azure AI Speech) to generate clinical drafts. You acknowledge that AI may produce inaccuracies, omissions, or "hallucinations."
Verification: You are solely responsible for reviewing, editing, and verifying the accuracy of every note before it is finalized in a patient’s medical record.
Liability: Listen MD AI is not liable for any clinical decisions, medical errors, or diagnostic inaccuracies resulting from the use of AI-generated drafts.
3. Privacy and Data Sovereignty
Canadian Residency: All Personal Health Information (PHI) is processed and stored on Canadian servers to comply with provincial residency requirements.
No Training on PHI: We do not use your patient data or audio recordings to train our underlying AI models. Data is used strictly for the immediate transcription and summarization of the specific session.
Data Protection: We maintain administrative, technical, and physical safeguards consistent with PIPEDA and PHIPA (Ontario).
4. User Obligations & Consent
Patient Consent: You represent and warrant that you have obtained express, informed consent from the patient before initiating any recording or transcription.
Account Security: You are responsible for maintaining the confidentiality of your credentials. Sharing accounts between clinicians is strictly prohibited.
5. Data Retention and Disposal
Ephemeral Processing: Audio files are deleted immediately after the transcript/summary is generated and confirmed.
Provider Controls: You are responsible for ensuring that the finalized note is transferred to your primary Electronic Medical Record (EMR) system. We do not provide long-term archival storage for medical records.
6. Third-Party Services
The service utilizes Azure AI Speech for transcription. Your data is handled according to the Microsoft Products and Services Data Protection Addendum (DPA), ensuring it remains within the Canadian Azure geography.
7. Limitation of Liability
To the maximum extent permitted by Canadian law, Listen MD AI shall not be liable for any indirect, incidental, or consequential damages, including loss of data or professional liability claims arising from the use of the platform.
8. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
